("European Rail Atelier", "we", "our", or "us"), you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service. If you disagree with any portion of these terms, your sole remedy is to cease use of the Site immediately.
2. Nature of the Website: Editorial Advisory Only
European Rail Atelier is an independent travel editorial journal, architectural itinerary advisory, and design studio. We are not a direct licensed railway operating company, nor are we an automated ticketing sales engine.
The content, route analyses, carriage comparisons, and timetable considerations provided across our articles are published purely for informational, cultural, and conceptual planning purposes. Rail itineraries, carriage configurations, onboard culinary menus, and track access are subject to operational modifications by national railway authorities and licensed operating carriers without our knowledge.
3. Intellectual Property Rights
All text, bespoke graphics, interface designs, logos, CSS code, scripts, audio-visual compositions, and editorial formats displayed on matemintpckbcn.yachts are the exclusive intellectual property of European Rail Atelier B.V. or its licensed content contributors, protected under European and international copyright, trademark, and unfair competition statutes.
You may not copy, scrape, distribute, reproduce, create derivative works from, or publicly display any editorial excerpt or design component from this site without our prior written authorization.
4. Acceptable Use and Prohibited Conduct
When engaging with the Site, you expressly covenant that you will not:
- Employ automated crawlers, scrapers, data-mining algorithms, or extraction tools to siphon our route guides or database components.
- Transmit fraudulent, defamatory, obscene, or unsolicited commercial messages through our contact channels.
- Introduce malicious software code, viruses, worms, or trojans engineered to compromise server integrity or access unauthorized administrative systems.
- Frame, mirror, or otherwise disguise the origin of any portion of the Site within external digital interfaces.
5. Third-Party Links & Operator References
Our articles may reference verified historical routes, geographical landmarks, or external railway organizations. These references do not constitute an endorsement, sponsorship, or legal partnership. We exercise no editorial or operational control over third-party websites or services and disclaim all liability for content, accuracy, or privacy policies maintained by external parties.
6. Limitation of Liability
To the maximum extent permissible under applicable Dutch and European legislation, European Rail Atelier B.V., its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from:
- Your reliance upon information, itineraries, or commentary presented on the Site.
- Service disruptions, timetable alterations, cancellations, or carriage changes enacted by third-party railway operators.
- Any temporary technical interruptions, bugs, server downtime, or transmission delays affecting the Site.
All content on the Site is delivered strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory.
7. Governing Law and Dispute Resolution
These Terms of Service, and any contractual or non-contractual disputes arising from your use of matemintpckbcn.yachts, shall be governed exclusively by and construed in accordance with the laws of the Netherlands.
The parties irrevocably submit to the exclusive jurisdiction of the competent civil court in Amsterdam, the Netherlands, for the resolution of any legal proceedings arising hereunder.
8. Severability & Inquiries
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of any remaining provisions.
